The story of memorandums is like this. If present law does not have provisions for certain things, then the government departments can publish a memorandum to give some kind of legal basis for their actions. Publishing a memorandum itself is enough to conclude that current law does have provision as such.
Usually these kind of memorandums are made against people who are vulnerable and do not have avenues/options to challenge. There were several memorandums made against undocumented workers not long time back. None of them stand the judicial scrutiny when challenged. Example, there was court ruling in many states that police cannot ask people about their immigration status.
The intentions of this memorandum is clear not to give any more H1Bs to small consulting companies.
I do not understand why some people in the forum have so much anger against the small consulting companies? This is just playing into the hands of anti's . Consulting through multiple layers is perfectly legal and a successful business model. No company wants to hire a person for 6 months project. It's been the goal of anti's to make small consulting companies look bad and they have been successful because of us. If this business model is bad, why not make laws to stop this type of business practice? If you ban that type of business, there will be no need for small firms hiring H1Bs.

I had my interview on 22nd Jan at chennai. Counsulate approved my visa and collected my passport . They did not return my passport for 8 days. On enquiry I found passport was under PIMS verification
On ninth day, I got the passport back along with 221g blue form, asking me to submit through dropbox original 797 AND 156-157 forms.
Anyone else has similar experience? How long woule it take after the submission to get my case processed.

Right, but employment and family are further broken into sub categories. Which group is FX (F1, F2,etc) and which one is EX(EB-1,EB-2,etc)? I see these two categories that are generally not in the visa bulletin I see on the state gov's web site:

I never have and never will like the idea of being asked to pay, I give what I can unasked. What of the people that by circumstance do currently not have these amounts of money to spare. I should not have to feel excluded nor should I have to explain my very personal reasons why to everyone.
Have you guys looked in the forums lately, people are getting "yelled" at and talked to rudely if they do not disclose how much exactly they have contributed. So we are only allowed to an opinion or help if we have money?
I will contribute when I have money to spare, however it seems I will have to leave this organization based on the comments that have been out there before I get to the point where I can afford to contribute. That goes for both time and money, some of us have responsibilities that we do not want to disclose.
*sigh* I might have just opened myself up to the ones that like to attack....go ahead...

I am sorry, I should have worded it properly. My message was for people tailgating too close. On a rainy day, one of my friends skidded and hit a vehicle in front of him when it stopped suddenly, but he was the one given the ticket.

Are you sure your namecheck is pending? How?
Do you have any written proof?
If there is no arrest record or any suspicious item in your application, your application may have been picked up randomly for interview. IV had worked on Namecheck issue in the past and namechecks should not be taking more than 6 months except very very few cases.

He contacted his senator to get the total number of pending EB apps for India.
Please see the response from the senator in the following link. It has pending applications by category.

I believe it will be the same old story. They will wait till last quarter and then will waste thousands of visa numbers because of their darn slow processing hands and we people will again start talking optimism from Oct 2010.

I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.
I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.
Finally, I did not get any RFE.

Good to know, thanks. Maybe we were reading different threads :) One thing though, because of the heavy rush of citizenship filing in 2007, combined with the election-year pressure of 2008, petitions were fast-tracked in recent years. There are so many confounding factors, anything is possible.
I can attest to this as well, I know couple of close friends one in NJ area and one in Bay Area CA both of whom got naturalized in 3-5 months time frame. This occurred in the last 2 months so this is fresh data. In both cases the N400 app was approved within 3 months of filing..And the interview was a month later after the approval. Again i just know these 2 guys so my data spread is limited. On other hand i dont know anybody in my circle waiting for a long time on N400.

IV has to priorotize before going to a lobbyist, with very very few contributions made, its very difficult to have everything bundled into a single request.
Its also unfair that L1 has to work for specific company but L1 spouces can work for any company any job, its so funny, when you think H1 has to work for specfic company and only for specfic job, but spouces can work for any compnay any job any salary without any labor department intervention
Immmigration awareness has increased a lot among US voters, when it comes to threat of their jobs being lost, and democratic senators are very much aware of it, hence CIR is no longer their priority.
I am not fighting but YES, my reason to join IV was to find justice to the H-4 not being able to work when L-1 spouses and Agjob spouses (I read this a year ago) could. Although no promises were made from IV, I was surpired today since nothing was ever said regarding no interest in the H-4 cause when many discussion were in place. Here people contribute for their own benefits, I was here for the H-4s, that is why I transcribed part of the conference calls too, so I was somehow a contributer to a cause that doesn't represnt my interests, but I know it represents the interests of the unmarried folks, or married to IT spouses folks.
