    I am thankful to everyone who read or responded even if you don't agree. Taking it a step furthur there are couple of things that stand out which i think again show how we twist every fact to our advantage.

    1) US need immigration to grow and prosper. wel agreed, but who are we to preach. Its for American to figure it out. We don't care for our mother land i:e India but we are first to point out how US will be worse off if it stops immigration. I really doubt the intention here. You know, we care more bout US then India and once we get our GC we probably wont care much bout US either.

    2) Saying its a fight for rights and if we don't fight we are cowards. well i agree we are all cowards not because we are not fighting to bring forward all mighty priority dates but because we showed our backs to our own country. We went to public funded IIT and other institutions and then ran away from our nation at first chance. So yes, in a way we are all cowards here.

    3) USCIS should be fair to India. If you look closely, USCIS rules are not country specific. Quota applies to every country, but only India, Mexico and china exhaust theirs. Does tell u something doesn't it.

    I am afraid you are being naive here. What the OP is saying is

    (1) We should all go back to our home land, because he has some opinions and positions on what is considered turning back to home land. You might not see it but he is trying to shape opinion of others very intelligently. Who says this? Some one who does not want competition here. Well, if this was coming from some one who is in India I will give him props. He is in US for 10 years and he is saying US GC system sucks and I will go to canada in 2 years. Damn it! I am better than him because I will go to India and not canada. I will stop short of saying that every one should go back to India or his/her homeland.

    (2) We all have no right to talk because this is not our country. or We are not in our country and we should not talk. Who says this? Again folks who dont want people here.

    (3) Even if I give him the benefit of doubt on other issues, he thinks country caps are OK. Any one who argues for country caps in EB GC with out asking for a country caps in F1/H1B which server as conduit to H1B actually wants the disadvantage to lot of people to his advantage.

    Just dont read the words as it is. try to infer some thing. These days trolls have got too much brains.

    I am with the same employer who sponsored GC. Until GC was approved I was with H1B visa. Is it neccessary for me to file I-9 after GC?

    I quite do not get what you are asking. You want to know if buying a call on an ETF that has had a drawdown with an expiration of less than 15 days will be profitable?

    There are various option strategies and I usually trade spreads as the most basic strategy. I rarely if ever buy just calls that too with such low theta (<15 days). I usually trade 4 legged spreads like the butterfly, iron condor or at least bull/bear calls/puts.
    Most of the time I am long vol (vega) with a strip strap or straddle. Sometimes I am short vega but hedge it with an exotic like a digital, or binary on the vix. I always go for optimal delta hedge and often construct synthetics. Never plain vanilla calls and puts unless I am hedging something else in a different universe with an option.

    If you can explain better what your strategy is I can make comments. If possible clearly state the greeks on the strategy so I can visualize it.

    something as simple as buying etfs when rsi2 is below 2 or in other words its beaten down and you are expecting a turnaround.

    would like to know if playing options on such short term( 1to 5 days) would generate profitabloe results or not.

    good thread. I do little bit of trading myself from a personal brokerage account and made some pocket change (few hundreds by trading commodity ETFs) recently. in layman terms, can u explain wht do u mean by ' US natural gas market is in contango' .

    First of all note that the original post was alomst year and a half old so dont go by the ideas there now :D

    In commodity markets you trade futures and spot. Spot means immidate delivery of the under lying commodity. In futures you pay today for delivery at a future date. So typically the price of the future will be the price of spot + the storage charge (simple calculation to give you an idea considering no premiums). As the day of delivery approaches the price will pull to spot price. For example if west texas intermediate (WTI) crude is $92 spot price the 3 month future will be $100. (92+8 for storage). Considering that the spot price does not change at all, in three months time the price of the oil you will now be purchasing will be $92, but you paid $100 for it. This is backwardation. This is usually how markets are most of the time.

    Now if in 3 months the price of WTI is trading at $110, you will own oil you paid $100 for and now can turn around and sell for $110. This is contango.

    When you buy a commodity ETF, they dont take actual delivery of the product, they roll their contarcts. So they will hold a 3 month contarct and when the third month approaches they sell the contarct and get another 3 month contaract. If market is in backwardation then they will always be buying high and selling low. If market is in contango they will make money but as soon as it switches back to backwardation they will ride down the slide and loose all the money they made. So I dont think ETF's are agood way of making money in commodities passively. You can actively manage the ETF portfolio and make money using options and hedges and leveraged ETF's. But buy and hold, I suggest go and invest with a CTA who will be trading rule based to negate the effects of contango and backwardation.

    Don't let lack of knowledge and fear of oppression take over your "thought process".

    AC21 is a public law - 106-313 .

    AC21 can very well be challenged in court. The reason AC21 cases do not go to courts is because they are resolved through MTRs.

    The issue with all this is that we are not raising our voices loud enough about this training issue or procedural issue ant it is always the individual who deals with the case at individual level by filing MTR.

    The entire beurocracy and red tape that one has to deal with in such instances is an issue. People have to file MTR - pay legal fee, involve lawmakers if they don't get response soon, write to Ombudsman .....

    So lets stop all "speculation", "fear mongering", "own intrerpretations" and work towards helping ourselves

    AC21 is a law. However, USCIS not yet published the regulation since year 2000, that binds everyone. All these memos since 2000, are internal to USCIS and not binding. They are very clear in the memo that revokation (except on fraud) of an already approved 140 by the petitioner, after 180 days of pending of 485, will not stop the approval of 485, if employee changes to similar occupation. This is just a non bining internal standard of USCIS. It does not have teeth, as it is not a public regulation. However, this internal standard can be changed by any time with/without public notice or through a regulation. Also, one should remember that, they mentioned in one of their memos that, regulation will be much tougher than memo.

    Therefore, as some one is mentioned that, an approved immigrant visa pettion should be always available at the time of issuing GC. That is also a law. This law also need to be met at the time of approval of 485. Therfore AC21 and requirement for availability of approved 140 is two different and counteracting issues.

    In practical situation, the employee has no control over 140 in any stage as it is employer's petition. Therefore, if employee leaves the job as per the AC21 law, employer verywell withdraw the 140 even after 180 days of 485 pending and create a situation of unavailability of approved immigrat visa petion for the employee. Therefore, in the final regulation they will make a rule that favours the employee, if everything was bonafide. It is like a aboundened spouse in family catagory.

    I think, USCIS is currently taking the tough standard to weed out the consulting compaines (to put a leash on GC factories/body shoppers), as they are the one mostly abusing the EB system. Only those people working in GC factories need to worry. It may be mainly due the current economic situation. I feel thats why they are delaying the regulation. Others need not worry.

    US citizenship is a final stop for most/many immigrants. Post Sep 11, there has been a surge in nationalization applications because technically GC is like a long term visa to stay permanently. Therefore there is always a risk of losing GC because of DUI or other trivial or accidental issues etc.

    Also post Sep 11, a lot of govt/sensitive projects that were available for GC only have been restricted to US Citizens. You lose a significant chunk of the available jobs market if you are a GC holder in the Maryland/DC/North Virgina area. In fact I know a lot of GC who kept their old passports but because of these hassles eventually decided for Naturalization.


    Yes that is the one reason. Moreover i can get the Indian citizenship back by staying in India for 5 years on OCI card or PIO card. It is that simple. But Once i go back to India coming here is big problem. So I planned to take USC and Do an R2I later whenever i need or I want.

    This week i became an USC after 9 years of stay in US. I can retain USC and stay in India. Came to US in 2000. Applied GC in 2002 Jan got the green card 2003 December with EB3

    funny thing is While starting the Interview officer said " Oh you are a new immigrant" . I said I am here since year 2000. Officer replied you have just completed 5 years on Green card.

    I saw the poll in the morning and voted FOR making this a paid site, but going through the discussions and a little bit of soul searching (slow day at work :p) i am a bit wary about making it a paid site now.

    As much as i would like to see the riff-raff (pardon the expression) go away, maybe we should be more inclusive then exclusive (?). Not everyone is an early adoptor, it took me a while to contribute as well, but i did eventually turn around and contributed the lil bit i could.

    Don't bet on this too much. Not being pessimistic, but in a democracy it is not just what is done but who does it and how it is done. Why should Republicans in the outgoing Congress vote again on a bill when their majority status is obsolete now? Do you think democrats will allow this outgoing congress to take the credit? they are politicians too, anything crappy in that bill is going to be the new Congress's (read Democrat's) burden. Already, a bombshell is waiting in the form of a hastily passed by the house_hastily signed by teh President bill: there is a fine print that removes oversight of how money is spent in Iraq (at least some of it). So, there may even be review of hastily passed, pre-election bills. anything more like this is going to give this congress very very bad name and the next congress a really bad headache.

    CIR is a heavyweight bill. Heavyweight bills passed hastily leads to heavy indigestion. Look at the parliamentary history in US and India. We need lite weight riders and hitchhikers. Pushing on CIR is betting on a horse that is soon to be retired, with masked broken limbs..

    Next move for EB should be THE decisive, concise, striking at the heart and quick. CIR is not the best bet for that.
    Somthing early spring would be the ideal thing to expect before the political capital is lost by the new congress.

    If figures provided to Senator are true and way Govt agencies working right now. I think first they will Put hard rule for Eb2 qualification. So almost they can shut door for Eb2. They may only allow 20k orless Eb2 in a year. For next 2 years no more spill over to Eb3. That way they can make Eb2 complete clear and becasue of tough policies it will remain C forever.

    now in 2011 Eb3 will get almost major chunk of spill and it will clear Eb3 in next 2-3 years. Also new Eb2 and Eb3 will be stuck at labor and I 140 stage meanwhile. I am expecting that they may come up with new policy that if person does not have approved I 140 , cannot file I 485.

    So People will be stuck at all 3 stages of GC. almost 8-12 months on each stage.This way they can remove almost 80 % backlog. Total will be 4 year to clean 80 % backlog. After 2013 there wll be only 200k pending 485 will be with them. Which is nice for them to approve 140k out of them easily in a year and leave 60k in a given year.

    USCIS cannot wait for politician to increase visa number. If something happen meanwhile like CIR or new point based system then its a different story.

    EB-3 India is last in the line so first EB-2 (WW) than EB-2 India/china/mexico, then EB-3 (WW) then EB-3 India/China/Mexico... basically my common sense tells me EB-3 India will get a big 'ZERO'....

    There is a spillover of 22000 visas from FB to EB starting Sep 01 2008. Does anybody know how this spillover is divided between EB1/EB2/EB3?

    Can we expect 28.6% of this spillover in EB3? Just like we get 28.6% of annual quota?

    There seems to be no pattern among recent approval rate-My coworker didn't get any update from USCIS- he directly got his physical GC on 4th Sept.
    We are still waiting, tried InfoPass, Raised SR, Contacted Senator etc.etc. I am willing to go to Lincoln,NE if that is what it will take to get GC:D
