I was looking at the recent forum posts and there was no discussions about EB3 listed. Thought would "BUMP" this to bring the EB3 plight on the top...

Received soft lud today on dependent's 485. Will update if anything else happens in the coming days..

you can document (some emails/documents indicating that job loss was possible) that you had to move because of things out of your control, i.e. you had intentions of working but because of situation you had to move, then you will be fine.
same things apply if you are laid off soon after getting GC.
i learned not to make career decisions based on "potential" future problems.

Finally my attorney from the previous company has received the withdrawal notice for my H1B with that company. The attorney also said that this was in response to the withdrawal request that the company has filed with USCIS after I left them.

As per my research and talking to customer service of few american and india insurance companies, You are partly right that no one covers pre-existing conditions.
But indian companies like Icici lombard, Bajaj allianz, tata aig etc cover emergency life saving treatment even if it was due to the pre-existing conditions. Which means if one is diabetic, reguler sugar check and doc vists will not be covered but if say patients develops a critical condition (e.g kideny failure etc) then the treatment is covered.
But american companies do not cover even the emergency treatment.

If we do not get this problem resovled who will ? All the members in this forum please start taking active part in determining your future your families future and your kids futures.. please do not be short sighted or procrastinate. Take Action NOW, we can do this, please encourage one more person to join in and contribute, talk to other people who are not aware of our plight and educate them, contact your local lawmakers, be active on the forums, support the core members and each others, come on now guys.. may be all of us cant do every thing but try some things at some of the times and some other things some other times :) -- does that make sense .. I wish I was very rich I would have made a HUGE donation to IV to fight for their cause... I really respect the core members for their tenacity, dedication and inner strength to carry on this effort.. admist so much uncertainity and so many obstacles .. and the best part is .. most of the people who will benifit from it dont want to do much about it ..... ok .. I am exhausted now.... Logic Life .. how do you do it .. keep churning out .. one passionate and well thought out post after another .. Does USCIS send RFE for both primary & dependent applications, if it is related to Employment?

I Don't think so. Logically even when the dependent works,the primary applicant's employer need to prove that they support GC process on that application.
They will not check for dependent EVL as it is not relevant in this case.
At the most they may verify dependent past non-immigrant visa status.

another nice topic to debate....i know that i debated with people about this a while ago and they made good arguments why setting immigration limits/controls by country origin is not discrimination.
Besides the limit is the same for all countries so very difficult to argue for discrimination

I am from India, and I am waiting for someone from other countries who does not even exist. And someone who does not exist (as yet) has a place reserved for him ahead of me, just because he is from that country
Maybe there is a better way of putting this.. no inspiration right now :)

Many folks suggest that this BIll (when turns into a law) would promote outsourcing..but how does these set of changes being proposed by Odama's admin. would affect outsourcing??

I know it wont "stop" outsourcing in any way but seems like they claim that they are " taking away the tax advantages of companies shipping jobs overseas"...Iam sure its more complicated than that..
However the kind of tone being set by the incumbent these days, I believe reflects the current administrations policies that might trickle to us(documented workers) as well.. not sure..
However this can be also looked at, the adminstartion si trying to "show" that they are doing whatever they can disccourage companies from sending jobs overseas..and then eventually take a stab at CIR..wishful thinking..:D

I haven't received the physical H1B approval notice from my attorney yet so I don't know what's the I-94 # on that one although I doubt it will be the same. AFAIK each I-94 number is unique and different. Anyway, I don't think I-94 number itself matters any, just the fact that you have valid, not expired I-94 is sufficient.
I did not fill the forms for the transfer myself (the attorney did) so I don't know for a fact what he entered in "last manner of entry" but I'm 99.99% sure they must have said "Paroled" as they asked for my I-94 that had "paroled" stamp on it to attach with the petition.
Finally, I did not get any RFE.
