    I do think a lot of times that Hillary has a better handle of issues and she is very articulate. Billary (yes Billary) concerns me. I think it is going to be tough to be just Hillary and not Billary.She had a good answer for it last night but it is hard beleive there will be no Billary. I visit hillaryclinton.com more than barackobama.com :)

    Obama definately is not as articulate as Hillary. However like many I want to see a completely new face as the democratic candidate. I knew Clinton's from when I was like 10 years old. They had their opportunity already and we have already tasted their approach. I am one of those people who is looking for a complete change. No clinton's, No Bush's, No Kennedy's. I am looking for young politicians to emerge through out the world.

    Let's see how Super Tuesday turns out.

    Salient features of Bill: S.1085

    After analyzing this bill, I found the following:

    1. This bill will recapture all those unused employment based visas (gcs) from 1997 till 2008 and it will add those recaptured visas to this year's employment based quota.

    2. After the passage of this bill, any unused visas will rollover to the next year. So, no more wastage of visas as we go forward.

    3. Per country limit will be increased from 7% to 10%, so more folks from over subscribed countries would be able to come under the normal yearly quota.

    4. We will be able to avail the benefits of the recapture after 60 days of the passage of the bill. That means, if they are able to recapture 220,000 (approx) employment based visas, the employment based category will be able to use all those after 60 days of the passage of this bill. USCIS is pre-adjudicating all I485s pending and if this bill gets passed in say for eg by October 30, almost all (80%) in this community (who filed 485) would be able get their GCs in Jan and Feb of 2010.


    What makes this bill much more interesting is:

    1. This is not a bill targetting the issues of Employment based category - So there won't be a huge backlash against this in the name of the economy and recession. The provisions for the employment category are just one item in this bill.

    2. Family based immigration reform has a wider range of support from all kinds of groups unlike Employment based immigration reform. Just search for this bill "Reuniting Families Act" in google news and you can identify all those organizations supporting this bill (they all have a news release).

    Following is my case....please help me make a decision on whether to see this through or not submit passport and just travel back on AP...

    Chennai consulate H1. (transfer from F1-OPT-H1).

    January 2nd - date of visa interview. Asked for additional info - 221g because I have a Phd in biology

    January 6th - submitted additional information. research. publications etc.

    February 1st (friday afternoon)- status updated to 'send passport' on chennai consulate website.

    My concerns are -

    1. How long does it take VFS to return passport, if I submit passport on Monday, February 4th?

    2. Would I still have to go through the PIMS verification or should I assume the consulate has already done this because they have asked me to submit passport?

    Please help if you can. I have already rescheduled my tickets twice...

    As Post-9/11 Security Increases Pressure on the Undocumented, Emerald Isle Offers Haven

    NEW YORK -- By now the shipping container carrying Jonathan Langan's material life in the United States has arrived in Ireland. The plush green furniture, his American flag and the construction tools of his trade are all gone from his Queens apartment.

    Langan, a lanky, red-haired Irishman, was bidding a final farewell to his adopted country. He didn't leave for want of work -- his fledgling construction company was booming. Success was his problem. The more prosperous his company became, the more Langan feared he would get snared by immigration agents.

    "You don't want to give off red flags because you're not supposed to be working," said Langan, 24, who lived illegally in the United States for three years. "It's too dangerous, what happens if you get caught."

    The green is draining out of the Irish immigration boom that revitalized neighborhoods across New York over the past two decades. Fear of getting caught in a post-Sept. 11 net coupled with the booming economy in Ireland is drawing thousands of Irish back to the Emerald Isle. Numbers vary on how many have left: The Irish government estimates that about 14,000 Irish returned from the United States since 2001, with more than half of them coming from New York. The Census Bureau reported that between 2000 and 2004, the Irish population throughout the United States shrank by 28,500 people, to 128,000.

    A more vivid picture of the exodus is the Gaelic downtown of the northern Bronx, on the border with Yonkers, where green signs and shamrocks decorate store windows.

    The Padded Wagon, a popular moving company among the Irish, shipped 30 containers to Ireland in the past three months, each containing the possessions of an Irish family. The Irish games -- Gaelic football and hurling -- have suffered losses. More than 200 players returned to Ireland in the past year, said Seamus Dooley, president of the Gaelic Athletic Association, which has its games at Gaelic Park in the Bronx.

    Last month, the Irish minister for social affairs visited New York, to unveil "Returning to Ireland," a guide for Irish preparing for a permanent return trip.

    "A travel agent was saying they had sold 1,700 one-way tickets to Ireland," said Geraldine McNabb, an Irish-born naturalized citizen, while she sipped a cranberry cocktail at a pub. "They're not coming back."

    Post-Sept. 11 security procedures have disrupted life for the city's undocumented Irish, who number about 20,000, according to estimates by Irish officials and activists. Few experience immigration raids in their homes and job sites. In 2005 just 43 Irish nationals were deported from the United States, none from the New York area, according to U.S. immigration officials.

    But federal and state policy changes, the fingerprinting of foreign nationals at airports and a crackdown on driver's licenses have made it much more difficult to hop a plane to visit relatives or drive a car. And tighter scrutiny of banking transactions to prevent the financing of terrorism has scared off families and made starting a business far more dicey.

    "What's more alarming to me is people who've been here for years and years are packing up. Families are moving," said Nollaig Cleary, president of the women's division of the New York Gaelic Athletic Association. "You've had the community people who set up business and their families, they're going."

    Brenda Flannagan, 31, immigrated illegally to the United States in her twenties, looking for adventure. Now she has a husband and a baby, and is looking to settle down. A trip back to Ireland to visit her parents could leave her open to discovery by immigration officials -- so she is going home for good.

    Raising a child will only compound her difficulties here. "You can't drive. It will get more difficult," said Flannagan, who expects to leave in the fall. "Things like play dates and after-school activities."

    With fewer immigrants pouring in, and so many Irish packing up, pub talk revolves around the question of the survival of the Irish spirit in New York. Irish immigrants poured in by the hundreds of thousands in the 19th century and again in the early 20th century.

    A third wave came in the 1980s when the Irish economy tanked, and it rejuvenated Irish culture in New York, as politically inspired Irish rock and hip-hop bands worked the club scene, and Irish theater and poetry spread throughout the city.

    "You have a great Irish neighborhood beginning to crumble," said Niall O'Dowd, publisher of the Irish Voice and chairman of the newly formed Irish Lobby for Immigration Reform. "Unfortunately Americans are mixing up terrorism and immigration."

    The Irish, however, retain considerable political clout. Fifteen years ago, they successfully lobbied Congress to direct tens of thousands of green cards into the hands of undocumented Irish.

    O'Dowd and other activists recently rallied the fighting Irish spirits at Rory Dolan's pub in Yonkers, as they begin lobbying for an immigration reform that includes a path to citizenship.

    The Irish government contributed 30,000 euros, ($40,000 at today's rate) to the effort. Tim O'Connor, Ireland's consul general in New York, stresses that the United States played a vital role in helping to stimulate Ireland's economic boom with investments.
    "It's in the interest of both countries that we have people who have the ability to go back and forth between both countries," said O'Connor, noting that 15 percent of new businesses in Ireland were built by returning Irish.

    Some Irish take their leave with optimism, looking to the jobs and construction boom in their homeland.

    "Everything is so good in Ireland," said Flannagan, while her husband, John, a carpenter, was at the pub enjoying "a few sociables." "There's a lot of construction work for the guys."

    Flannagan held her baby girl, a U.S. citizen and last link to the United States. "Maybe she can sponsor us when she's 21," she said. Then, she added, "I think the notion of coming back, by then, will be gone."

    I thought EB2 vs EB3 is mainly determined by what your job requires.. You may have a Masters but if your JD does not require one, the company cannot file you on EB2.

    The job must qualify for EB2 first, with at least min prevailing wage!
    Which means BS+5 yrs of Progressive Exp or MS as min requirement.

    I have come across some cases where GC aplication I140 was reopened after being approved. So this is no surprise. While I could not find the reasons fully in many cases, why cases were reopened as people tend to hide the true reasons. I think for GC applications the reasons may have included-- suspicion of fraud/complaint against the employer/Ability to pay after seeing more GC applications in the same company and thus reopening past cases/Bona fide intension of the employee to join the company after seeing some irregularity in the immigration applications/too many GC applications or H1B applications from the same company and thus a red flag for an H1B dependent employer.

    The best solution in such cases is to first find out the reasons and weakness in your case. Each case is different and one cannot generalize. So each applicant will know their reasons. If the case is reopened, then don't panic. But if you get an RFE, the immediately contact a good lawyer and answer it.

    I had the same kind of situation . I work for a Fortune 5 company . The prevailing wage some how came to $5000 more than the salary than the company pays me ( I think I am pretty competitively paid ) . Our attorney team told me that this is nothing to worry about . The wage difference actually matters when your I-485 is filed and about to be approved . So you could actually go ahead and file the labor and get the I140 approved and wait for your wage to rise to the levels ( you will have to wait anyhow for a few years ).So if I have to wait for like 3 years for my GC my wage will surely rise to USD 5000 in 3 years . Also remember that the total wage is the sum Salary + Joining bonus + awards + yearly bonus . So you could add these things to give your total wage .

    That is really odd. Is your I-140 approved?

    Joining Bonus, Awards, and Year Bonus are NOT part of salary unless it is defined and guaranteed for every year.

    We advice not to use this template and form. The message and the organization sending it for their advocacy agenda is very important. Even if you change the wording, people will hardly read the letter. They will look at the organization that sent it and its agenda.

    If you email or call your Congressmen or Senator, do tell them that you are a member of ImmigrationVoice so that their office can make the connection to your calls, meetings and emails in our advocacy meetings. Another point to note that in person meetings have much more effect than emails. You may get a standard reply to your emails. Sometimes the response may talk about a general immigration position of the senator rather than a specific reply to your question.

    BTW do not quote any bill # yet. If you want to talk about Recapture, just say recapture of unused visas for Employment based category.

    Not sure I follow your argument here. Why should we not pursue the CIR and Recapture Bill action alert via AILA site. Also I am curious to know why IV has not put up a fax campaign for the same - given that this issue is clearly the focus on much of the IV agenda. Finally, I would think that while it is important to campaign directly to those in the know and power, as IV does and encourages members to do, there is something to be said for the strength of numbers. And one of the many ways IV can demonstrate that strength is not just to quote numbers in lobbying efforts but also to display direct interest of members and indeed non-members via faxes sent. IV Core and Donor Forum - some response from you would help us understand the path being pursued here.

    Thank you very much anandrajesh, nk2006, ramraj_02, nviren, and neel_gump. Keep up the good work. It is good that more and more people and coming forward and making their first, second, third and fouth contribution.

    One would make contribution only if they have confidence in IV. Today IV have more than 2000 members. Let's join hand and make Immigration Voice stronger by contributing $100 or more one more time.

    We have al ready seen that Immigration Voice have shown their ability what they can do with all your help. We have not yet achieve the goals but we are not too far from that. One has to understand that Immigration Voice is an organization owned by you and me and so please contibute so that Immigration Voice can work and solve the retrogression problem.
