    I have not contributed much as comapred to top guys but I have generated atleast $600 through my efforts to rope in new guys & requested them to put in some money. Some did but some did not

    Same here, infact i was even lucky enough to generate abt $200 from 2 american citizens of Indian origin of my community.

    My PD is Nov 2004 (EB3 India). My 140 has not been approved yet. Also, I do not plan to use EAD so issues thereby are out of question. My only worry is can I keep renewing H1B while my 485 has not been approved. My attorney says NO. He says that you can apply for H1B extensions after 6 years only if you have not been able to apply for 485.

    However based on your responses, it looks like I will have to validate this with some other lawyer to make sure if I can keep extending my H1B so I can maintain my wife's H4 status.

    From what I know your lawyer is wrong, you will get one year H1 extensions in your case.
    ask another lawyer or go over older Murthy chatlogs/faqs.

We are all just waiting for someone to do it because we cannot do it. We all just write good posts and are free riders. But if you are willing myself and my friends on H1B will support you.     What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.

    It is not really a reverse-brain-drain. It is just less than 100% people on work visas attempting to stay permanently. Reverse-brain-drain will be when American born (or well established people) try to move to other countries. Some living here for few years, finding difficult to get used to American culture, food, life-style, etc., might decide to go back to their native country, but that is not reverse brain-drain.

    Revere-brain-drain may happen in the future, but it is not there yet.

    Well said Sir, and now as President-elect, we hope to see some action on above.

    This issue I bring to your attention may seem trivial, but throws light on darker side of the life of dependent H4 visa holders, who are mostly women. And since you endorse women empowerment, I believe you will give a serious look at this idea.

    Theres a strong lobby support for increasing H-1B visa cap to address the shortage of skilled workers. Theres also a strong lobby opposing it. This idea will satisfy both the lobbies. A very simple way to literally double the number of already available skilled workers in the USA without having to increase the visa cap. Allow me to explain....

    Currently the spouse of H-1B holders, the H4 visa holders are not allowed to work. Most of these H4 Visa holders are qualified, skilled and experienced. In one stroke of the pen, by amending this tiny rule allowing H4 visa holders to work, you will facilitate thousands, if not millions of already legal & available skilled workers in the US, to work. Please note that spouse on L2 Spouse/Dependent visas for L1 visa holders (intra company transferee's), ARE allowed to work through an amendment in 2001. And this can be used as a precedent. Even J and E Visa spouses (J2, E2) are allowed to work.

    Good For the Economy: While its now a norm to have a dual-income family where the husband and wife both work, its become all the more necessary for a family to just survive through these unprecedented economic times. H1-B visa workers typically stay on for at least 3 years continuously if not extend it for the next available 3 years. All this while, the poor H1B and his family have to get along with just one income. Moreover, the law also forces the skilled and experienced spouse on H4 to idle at home. This I believe is a loss of national productivity. Your statistics will prove how many H-4's are currently idling away in the US.

    Good for the Community & Social standing of Women:
    To keep the family together, H1 visa holders bring in their spouse on H4 visa. And then, they get locked in the house. Ninety percent of H4 visa holders are women. Women being, more susceptible to domestic violence by the partner, becomes even more prone to violence due to her complete dependence on the spouse. They become prisoners in USA due to spousal abuse and immigration policies that give their husbands complete control over their lives. Yes, the immigration system is broken. The immigrant women get protection under VAWA but non-immigrants are not covered. Even if a law to let the non-immigrant battered women to obtain work permit is introduced, it might not protect women whose cases are dismissed as non-critical. The abuser can further exert his control over the victim and convince her that he has changed so that the victim might not press charges. Thus the abuser gets encouraged to continue violence. Divorce is not an option because most non-immigrants come from third world countries where a divorced women has to bear the social stigma of divorce and will not be protected in her own home country. Because of the long queues for Labor certification application and retrogression of visa numbers, getting an EAD and Green Card takes longer.

    Way Forward:

    You plan to legalize people living illegally in USA (and working illegally), you plan to give them a low skilled requirement job visa, similar to the H-1B or L-1, only that skills required are low, and you will let their spouses work too. This will mean that the only resident visa holder NOT AUTHORIZED TO WORK will be the H-4 visa holders.

    As a tech-savvy President, you may also want to browse this issue on Google groups and hear the voices of depressed, frustrated and more often abused women, here... Oops. I am unable to provide you the link as it appears to violate the change.gov comment policy (?).     When people who have come to the US illegally will be able to work legally � the poor H4 souls (mostly skilled women) who have come legally and followed all the rules should be given a fair chance to contribute to the economy and better their quality of life. By a simple amendment, allowing the H4 visa holders to work, you will make a brilliant move, without upsetting those who oppose the move to INCREASE the current H1B cap. Please think about it.     I filed 485 in Sep 2003.
    First Finger Print is done in Aug 2004.
    Second Finger Print is done in April 2007.
    Took Infopass on Sep 11th 2007 and I was told by Officer that everything looks good but still pending and asked me to check after 2 months.
    Took Infopass again on Nov 13th 2007 and came to know that FBI Name Check is Pending on my and my wife's cases.

    How do I know how long FBI Name Check is Pending on my case ?

    Unless there is reform....it is very likely that EB2 India would stay where it is today for a very long time....It may even retrogress further...In 96-97 there was a time when EB3 was better than EB2.....That might not happen ...but EB2 India is definately not gonna be too much better than EB3...All people are now trying to get into EB2 wagon and that is gonna is almost as bad as EB3 .....

    Money is important and has its place in the process. Grass roots effort is also important. What would you tell if some one asks which eye is more important to you? left or right? If this Q was a stretch, ignore it. I just used it to tell that $$ and grass roots efforts are important

    Money does not get every thing done. Corp America is doing everything they can to get H1B numbers increased. Do you think they are being stingy with the money they need to spend? They have stronger opposing grass roots groups like Numbers USA, FAIR etc. Our issue is a lot less volatile compared to the H1B increase issue. How ever our issue is unknown to many lawmakers until recently. I am positive that some members came to know about the bills when we called them or have been approached by our state chapters.

    While denial is beautiful, stupidity is frustating, isn't it?

    I realize that there is no point in telling you guys anything. When you don't have an open mind, you can not accept the facts. It's like banging your heads against steel wall. When you are not even ready to diagnose the disease, there is little hope you will be able to cure it. Denial is a beautiful thing.

    you can document (some emails/documents indicating that job loss was possible) that you had to move because of things out of your control, i.e. you had intentions of working but because of situation you had to move, then you will be fine.

    same things apply if you are laid off soon after getting GC.
    i learned not to make career decisions based on "potential" future problems.

    If you can porting to EB2 is always a better choice.
    For EB3-I's with PD > 2005 it is worth the risk even with the gray area that USCIS may not accept the porting. An EB2 I PD of 2008/9 will always be better than EB3 I PD > 2005.

    HR 5882 is the only solution for all atleast for this year.

    I think one very serious point in favor of filing now is if you do not file, and the lawsuit is successful in about a year and a half as they say and your PD hasn't become current by then, it puts everyone who filed in July ahead of you and this might cause the USCIS to retrogress visa numbers to such an extent that it would take ten years for your PD to get current again. Would this be a correct assessment?

    Hi

    It is really frustrating that some people instead of volunturing for effort tries to find loop hole or excueses in the IV's efforts. If you can not volunteer atleast support those who are doing that with lots of energy and determination for our cause.

    Utlimately at a one day WILL WILL FIND A WAY.

    If we are willing to help ourselves than only this thing will happen.

    So keep faith in IV core and its efforts and be supportive to their efforts whenever you can.
