Thank for contributing again to IV. You and other members like yourself would be the reason for IVs success in changing the flawed green card system.
Thank you for encouraging other IV members for contributing. As you know, this is very important and more amongst us should encourage our fellow IV members to contribute. Often times it is evident that few IV members are struggling to keep a positive tone on the forums. As you may have experienced, it is easy to post few messages here and there. The message of some of these posts is to throw out ideas for others to implement. But in the end, the success of our community will depend on the contribution from kind members like you. Thank You.

With my very best wishes to those of you waiting for your GC, this thread is created for the lucky among us who received it recently. I am putting together a list of things to do, and not do, to maintain our freshly minted PR status, which should also help during future citizenship application. The list is mostly about little things that others have learned from experience (and I am learning from their experience, by reading in immigration-related forums such as IV). The more obvious things that can be found for example in USCIS handbook (http://www.uscis.gov/files/nativedocuments/M-618.pdf) are not included here. Gujratis who own motels and shops and will want more family immigration vs H1B

Indians who are now citizens. They will want less Indians to reduce competition for their jobs or for their children.

This is a great point. Even if we get one time relief,that should suffice because retro might not happen in the future as there will not be 245si/195kH1bs. I hope one of the core group members might want to look at this. This will atleast counteract the exaggerated and bloated immigration numbers by the antiimmigrant groups.
It is just speculation that it will take 10 years or 15 years. Actually past 3 years atleast 50% h1 were used by TCS,WIPRO and similar companies. So those who are processing gc is less. But it may take some time to clear current backlog as we had 195k H1 cap till 2003. If 65k h1 cap is there then it will be 3 year waiting period for EB2 and 4 to 5 year for Eb3. People will speculate based on number of H1s. But their calculation is not including the number of people who are giving up and also many people are going back. But if they increase H1 then the situation may become worse. I think one time releif will be enough to resolve the issue for
next 5 years. But Skil bill is asking too much(May be for permanent resolution of
gc issue) and opposition is more as anti immigrants are quoting the numbers. Remember in 2000 the relief of recapturing previous few years did not attract
large opposition and passed easily. Simlarly if H1 increase also limited for 2 or 3 years that can be passed easily as we can convince Senators like Sessions.
But if we keep on asking so many numbers of H1 and Gc and also exemptions
for Master degree then we have to wait for CIR as this will have lesser impact
in numbers compared to illegal immigrants.

how long after the soft LUDs did you get the hard LUD (RFE)?
And what was the RFE for?
I had a soft LUD on 3/19/09.

Yes, there are sub-limits in ICICI for persons above the age of 55 years. Please look at the policy wording, a 16 page document. Look at Page 3 in a section called 'Special Conditions'. It is mentioned there.

There are far too many points here to address at one go. Let me touch upon this for starters:

I saw the poll in the morning and voted FOR making this a paid site, but going through the discussions and a little bit of soul searching (slow day at work :p) i am a bit wary about making it a paid site now.
As much as i would like to see the riff-raff (pardon the expression) go away, maybe we should be more inclusive then exclusive (?). Not everyone is an early adoptor, it took me a while to contribute as well, but i did eventually turn around and contributed the lil bit i could.
Thats just my take, and excuse the rather altruistic title of my post.

Does this amendment strictly apply to new H1B filings or will it also impact people with H1B and an approved I-140 but need to extend it due to retrogression?
Regarding the exodus, maybe that is their purpose. Maybe, they have enough
hi-tech workers and they don't need more. I guess we need to watch and wait and accept this as a reality.

Congrats Man, all the best for your future, I have yet to apply for GC (i am in my 4th year of H1 B, my company said they would take care of it, and they are painfully slow, i have now been here for 7+ yrs).
Immigration is personal choice in my opinion, i am sure it makes sense to say i am proud of my heritage/culture, but like everybody else i came here for a better life.
The wait for GC is very very frustrating, other the other hand it is absolutely unnecessary if the Immigration authorities just put a little effort and time into resolving it, I guess that is a underlying statement about skilled Immigrants, you have to go through a lot of frustration, pain, and anxiety to be worthy of a GC. I am beginning to wonder, if all the energy (positive and negative) i am spending here to get my GC could be spent more efficiently and in a calculated manner in India (:confused:)
I am from India, I hate corruption and bureaucracy prevalent out there, I came here for a life filled with fun and freedom(what i thought was a better life :(), i still would like to have GC, but the wait, the tension that i need to take out here, is pushing me back to thinking maybe coming here was not a good choice in the first place, my Family is in India, and a couple of my friends are still around in India , so hopefully, when i DO go back i can hang around them and have FUN.
As one of the members said, you cannot take India out of a man, why ?, because we have 5000+ yrs of glorious documented history, a wonderful ,colorful culture, and is the home of great people, that's why !, and that culture is entrenched in our psyche. The generation of kids born to indians here is US wont/cannot/ relate to that psyche, people like us export India, but for the next generation India ceases to exist, just my 1 cent.

Just curious. Why do you claim ROW is receiving preferential treatment over India when all the countries get the same upper limit of the visas. Now if the Indians ask for more visas just because there are more Indians asking for green cards, wouldn't that be preferential treatment? :)
Why do think that "India" is the name of 1 human being that everyone from India should be treat like 1 person. Each person applies for his/her I-485, even each member of a family is considered separate. So why club one group of people based on a dichotomy that works best in your favor and then argue that there should be no change. Why not apply color of skin to decide the limits, or maybe the language. Because frankly, which country I come from has nothing to do with why I am here, just as the color of my skin or my native language has no relevance to my petition. In any system if you club large group of applicants based on a dichotomy, and say you will get lesser share than the rest, isn't that how you describe preferential treatment ? Is there any other way to describe the current country-quota system? Why not say Tamil SriLankans will autonomously govern 86% of the land and rest of people in Sri Lanka should migrate to the remaining 14%. Is that how it works there? Probably not, then why argue for something which is actually nothing but preferential treatment. That's ok, in olden days, when racial discrimination was legal, people who benefited from it argued in favor of it, just as you are doing in favor of per-country limits. But the society is much better without racial discrimination. Don't you think so? Any special benefits accorded to one set of group over the other is preferential treatment. There is no other way to describe it. Now, if you got a job, which is why you are here, based on the fact that you are from Sri Lanka, then it is a different thing, then you must get green card based on which country you came from. Is there any relation between your job and your country of origin? NO. That would not be preferential treatment. Because as I said, India is not 1 human being who ought to consume the same oxygen as 1 human being namely Sri Lanka must consume. NO. That would not be preferential treatment. Because as I said, India is not 1 human being who ought to consume the same oxygen as 1 human being namely Sri Lanka must consume. Each applicant in employment based green card is a separate human being. Hope you are not proposing to ration oxygen based on country quota.
Look, I know removal of per-country quota may not work in your favor so you do not want to remove it. Tell me that it is not true and this discussion is over. And if per-country quota puts me at any dis-advantage as compared to you, isn't system giving you preferential treatment over me? How else will you describe it?

I must say that this is a great great effort. Both, the flower campaign and the rally. Nothing like this has been done before by wanna-be immigrants. We are hardworking, law abiding, well educated people. But until now, the general opinion was that we are at the mercy of the American immigration system. I was especially so frustrated when some of my friends thought that there was nothing wrong in what the USCIS did. Their response was simply "what can we do? let's just re-apply when the dates become current again". Historically, Indians (at least, from my experience) have been hesitant to protest against the wrongdoings of their rulers. This is seen even today, when we fear to raise our voice when our bosses or managers at work exploit us, or our advisers/professors exploit us, or if the USCIS changes rules in the middle of the game. In India too, the general opinion is "Nothing is going to change, let's not get into trouble". This rally has shown that things are changing. We all should wake up, and fight for our rights! I could not attend the rally as I am based in Michigan, but I thank all of you who protested for me and my family. I will do my best to support this effort in whatever way I can.

Folks I have an update on my case.
We filed for Motion to reopen on which were receipted on March 27th, 2009. I wrote to Congressman, Senators and also Ombudsman. Today my congressman's office got an update that our MTRs were approved on April 30th and our 485s got reopened and they have sent letters to that effect.
What a relief. It was a stressful 6 week ordeal. Thanks to IV and its members for the help and support.
Congratulations. I wish you never had to go through all these.
