Yesterday, I got RFE for myself and my husband and need to respond by April 29th.
On my husband's 485 application we entered Last Entry Date wrong, they asked for the proof for the same and all I-797 issued to him so far. We have all his I-797 approvals and he was never out of status, but just worried that we put wrong date for Last entry Date.
I have sent the RFE to my attorney, waiting to hear his response. I am really worried what it could mean, not sure if it is a big thing or a simple RFE, need your advice.

I also have another question, my husband is on EAD since last year. Our 6 years on H1 are expiring in June 2009. Can he get H1 for the period he was on EAD?

Couple of my friends, who have 3 year degrees from India and also have 2 year Masters degree from India, have not been able to apply for EB2. Their lawyers suggested that 3 year degree are a hindernace to get EB2. They both have not tried applying for EB2 and both have active EB3 applications.

It is very difficult to get a bill passed in House for increasing visa numbers. Be it legal or illegal there is no way House will pass anything that increases visa numbers this election year. I am doubtful even for next year.
For this year or for now we should just get something like "ability to file 485 even when visa numbers are unavailable". This is something which will provide some relief to all of us and has good chance of going through. Subsequently we can keep trying to get the SKIL bill passed next year.
Absolutely. Now with PERM and premium 140, if we can file 485, and then hit the snooze button for 10 years -- no problem for me. I know, not everyone will be lucky to board onto the PERM, but atleast it will be relief for most of us.

From the article it seems Tancredo gives wrong information about H1b. Generally CNN is not responsible for any other person is giving wrong information in the interviews unless CNN accepts the information. Daily they are interviewing many people including Politicians and there is lot of chance for wrong information. Many persons gave wrong information about Iraq in CNN but CNN could not be responsible for that. If Lou Dobbs gives/accepts wrong information then we can complain about him in CNN. So if action needs to be taken we need to protest Tancredo for his comments.

I have been following this thread for the last few days and wanted to share some info. Hoping it would be useful.
I entered the country in Jan 08 using the AP while I was still working for my GC sponsoring employer. Then in June 08 I joined another employer by transferring my H1B to the new employer. I did have the option of using EAD but I wasn't sure if the renewal will come before the expiry of current EAD. So decided to transfer H1 and my new employer graciously agreed to it.
We did a premium transfer so got the approval in 2 weeks. Money does wonders (Almost like the proverbial paper weight with files). I confirm that the I94# number on I797 approval notice is same as the I94# number I got when entering the country in Jan 08.
So this should be a good news for folks who are trying to do the same. I am in a different boat right now. I have to travel to India this November. I plan to return using AP. But now my employer is different from my GC sponsoring employer. Another issue is that I am going only for two weeks while my wife will be in India till Mid Jan. So we will enter US separately using AP. Please share your thoughts if you have been in this situation.
Can you pl update about your second entry via AP, after H-1B transfer. Did you entered successfully.

This might sound weired..but I think we can get some support from Housing Market !
Facts:

The housing market is slowing down significantly and there are millions of unsold homes out there.
More than 1/2 million people are stuck in the green card process. I am sure
most are waiting for green card before they buy their house and make longtime commitment.
I think we are a "Frozen" pool of customers for the Housing Market.
500000 H1B X 300000 (average house price) = 150 billion dollar market is just
inaccessible just because of retrogression.
I think we should convince them to help us FINANCIALY

Lou is talking about H1 badly. Does he know how schools are facing problems without H1. Thousands of schools have no math and science teachers in rural areas. Why cant he make the americans to work in that area. Most of the schools are using teachers over 75 to 80 years old. Most of them didnt know how to use computers. Then how they teach good to students. Principals are struggling to run the schools with out teachers. Parents are disappointed without proper teachers. With this level, how can America make best future.My kids are struggling without proper teachers. When we ask the schools, they are saying they couldnt get proper teachers. If Lou's grand kids face this trouble, then he wont talk. With this situation, how schools can make AYP(adequate Yearly Progress) according to No Child Left Behind Law. First the Govenment must take necessary steps to solve this issue

I was transferred to a IO yesterday. She was rude, told me that I should not be calling since they responsed to the first SR that was opened by my attorney on 09/01.
Not sure if you read the other thread, but I have got 2 responses from USCIS so far - one for inquiry that was sent when I took the Infopass and the other one that was opened by my attorney.
Response that I got for inquiry from my Infopass was " Based on the additional documentation provided, your case qualifies for expedited processing. You should hear back from us in 60 days. If you do not hear back in 60 days, please call us back".
I havent provided any documentation to them in the last 2 years, after my FP was done in September 2007.
So when I talked to the IO, she read out that message to me and in a subtle way asked me "What part of that message do you not get"?? I was trying to explain the situation to her, and before I could finish - she said "Sir, I got to move on and take other calls, please dont call back before November 15th".
And then she said the part that chuckles me the most - Sir, is there anything else you would like to me repeat, or do you have any other questions.....??
Hell yeah, I only have one question - when will I get the magic email?? :o

I dont know if that's completely true. I had my H1B visa appointment on Dec 28th in Mumbai and am in the PIMS verification status also. The visa officer told me that all NIV applicants around the world have to go through the process and admitted that the process was new.
I talked to 3 other H1 candidates right after I was handed the yellow slip and they all had the same experience with different officers. Although its aggravating, hopefully, we'll all get some relief this week.

Well ... I could partially agree to your rant. While I understand your point of view it is not justified on your part to generalize all posters into one category. You should have been more specific about what kind of posts (and even posters if you wish) frustrate you.
In my view your words "Get a life" certainly applies to the following set of people (in that particular order):
Those who say they are awaiting their GC to plan their lives (get married, have kids, buy a house etc.) I am married with a kid and bought a house and all I have is a I-140 approval (Not applied for I-485 yet). So what happens if I loose my job? I will make an honest effort to find one and if I fail I'll sell my house and go back to India. I am prepared both mentally and somewhat financially too. As much as I want to live in the USA it is common sense that I always have a solid back up plan to go back if need be.
Those who come here whining about their I-485 getting rejected and don't have a back up plan. Seriously, how many times must you get jacked before you realize that USCIS is not dependable? How the heck can one plan their life around it? One must realize that GC is just a small part of your life and not your life itself. Get your priorities straight.
Those who say that laws are racist. Hilarious! BTW racism is not one way (like the Whites out here want you to think) so beware of what you say unless you don't mind getting sued.
Those who build up their hopes with predictions on the next visa bulletin and go emotionally crazy when the hopes crash with the release of that bulletin. I mean c'mon ... flower campaigns? hunger strikes? Are you that naive to think it worked the first time? This ain't a factory in India and we aren't a group of union workers.
The above form a very small group of people on this website and that is where the problem lies with your post. You are basically stereotyping all of us into a category formed by a small group of people.

2) US has every right to choose whom they want to have in their country.
3) If getting PR or citizenship of a western country is the goal there are many countries which have a fair point based system.
4) Considering the number of fraud's committed by Indian body shoppers and people who use them, i am not surprised USCIS is extra careful when it comes to Indian applications. Anyone who got his wife with no exp with software dev an h1b visa from some cheat in Jersey knows what i am talking bout . My freind got his wife an H1 after showing she knew software testing even though her major was fine arts and all she was good at was web surfing :)
5) have a back up. i came here in 2001 as student and have seen it all. I am on h1b since 2004. i knew we have too many people whose sole aim in life is a American GC. to avoid becoming one of those who check processing dates first thing in morning, i applied for Canadian PR, got it in 8 months and i am not even gonna bother applying for labor, i-140 and all those precious life controlling documents.
Wake up friends, you have options. Don't let your life depend on you application status.

From what I understand, once the law comes in to affect, labor substitution will no longer be allowed so desi companies can't sell labors anymore. But the 2nd part of the puzzle was that approved labor will only be valid for X number of days (like 45 days as originally proposed) and I am not sure if this impacts the existing labors or not. 45 days expiration may only apply to new labors but no details has emerged yet so we'll have wait and see when the details come out. If it also applies to existing labors then we are home free because after the expiry date, all labors will automatically be canceled. Well, let's wait the for the fine details to come out first.
If this law does not apply to existing labors, we will still be in the same situation. BTW, what is a desi company. How come it can sell labors? Is selling labor legal?

What is this reverse brain drain ? there is no such thing - folks who are here are going to hang on tooth & nail to stay here come hell or high water - the only ones who are going back are the ones who have no other option.
It is not really a reverse-brain-drain. It is just less than 100% people on work visas attempting to stay permanently. Reverse-brain-drain will be when American born (or well established people) try to move to other countries. Some living here for few years, finding difficult to get used to American culture, food, life-style, etc., might decide to go back to their native country, but that is not reverse brain-drain.
Revere-brain-drain may happen in the future, but it is not there yet.
